Infatti, la Corte di Cassazione ha ritenuto punibile per stalking la persecuzione attuata anche con video e massaggi inviati sui social network, con la sentenza n. 32404 del 30 agosto 2010.

La sesta sezione penale della Suprema Corte con la statuizione in esame ha confermato la custodia cautelare pronunciata dal Tribunale di Sorveglianza di Potenza nei confronti di un uomo indagato per aver inviato una serie di filmati a luce rosse e fotografie alla ex e quindi per il reato di “atti persecutori” di cui all’art. 612-bis c.p., introdotto con il D.L. 23 febbraio 2009, n. 11 meglio noto con il termine anglosassone “stalking”. Secondo la sentenza l’uomo dopo aver avuto una relazione sentimentale con la donna aveva iniziato ad inviarle foto e video che li ritraevano durante i rapporti sessuali. Uno di questi era stato inviato anche al nuovo compagno di lei.
